This Privacy Policy and Cookies Statement (the "Privacy Statement") describes how Bluvo, Co., and its affiliated companies (referred to in this document as "Bluvo," "we," "us" or "our") collects, uses, shares and otherwise processes Personal Data (defined below) related to developers or counterparties ("Developer(s)", "You", or "Your") using our products or functionalities, including:
• Visitors to our website(s), https://bluvo.dev/, mobile applications and other online properties, including, https://portal.bluvo.co/, ("Site" or "Sites"); and
• Any other individual about whom Bluvo may obtain Personal Data.
If you are a Developer, please note that it is your responsibility to ensure that your end users are aware of, and consent to, the processing of their personal data in accordance with this Privacy Statement.
In this Privacy Statement, "Personal Data" means information that (either in isolation or in combination with other information held by Bluvo) enables you to be identified as an individual or recognized directly or indirectly. We may collect Personal Data when you use our Sites. You are not legally required to provide us with any personal information and may decide to do so (or avoid doing so) at your own free will. If you do not wish to provide us with personal information, or to have it processed by us or any of our third party services providers (as described below), please do not visit our Website or use our Products or Functionalities.
Bluvo collects information that you provide directly to us when you use our functionalities and browse our Site. We may also collect Computer Internet Protocol ("IP") address, unique device identifier ("UDID"), cookies, web beacons, web server logs and other technologies and other data linked to a device, and data about usage of our Sites ("Usage Data"). A "cookie" is a text file that websites send to a visitor's computer or other Internet-connected device to identify the visitor's browser or to store information or settings in the browser. A "web beacon," also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.
Other types of information we may collect include your name, username, password, date of birth, country of residence, nationality, residential address, identification document type, country and authority that issued the identification document, digital asset wallet address for integration and transaction history, information on the currency in your account on our Site, and any other information you choose to provide. We may also collect certain transformed data, including hashed representations of your identification document, tax identification number, International Bank Account Number, phone number, and email address. We do not have the ability to reconstruct or read the underlying data from them. We may use automated technologies to collect information about your equipment, browsing actions, and usage patterns. The information we obtain in this manner may include your device IP address, identifiers associated with your devices, types of devices connected to our services, web browser characteristics, device characteristics, language preferences, referring/exit pages, clickstream data, and dates and times of visits to our Site.
Bluvo may require certain information from time to time for purposes of meeting its due diligence requirements specifically to comply with applicable legal, regulatory and business/reputational requirements.
We use the Personal Data that we collect:
• To make our Site and its functionalities more intuitive and easier to use, we use device data, cookies and other information that you may provide. This data is necessary for our legitimate interests in monitoring how our functionalities and Sites are used to help us improve these functionalities and Sites, and the information and tools available on these functionalities and Sites.
• To provide relevant marketing including providing you with information about events or services that may be of interest to you. It is necessary for our legitimate interests to process this information in order to provide you with tailored and relevant marketing, updates and invitations.
• To carry out any other business purpose for which the information was collected.
• To post job openings and opportunities on our Site. If you respond to one of these postings, we may collect your personal information, such as your application, CV, cover letter, and/or any other information you provide to us.
We may also use automated technologies to collect information about your equipment, browsing actions, and usage patterns. The information we obtain in this manner may include your device IP address, identifiers associated with your devices, types of devices connected to our services, web browser characteristics, device characteristics, language preferences, referring/exit pages, clickstream data, and dates and times of visits to our Site. The information we collect through cookies and similar technologies helps Bluvo (1) remember your information so you will not have to re-enter it; (2) understand how you use and interact with our products and website; (3) measure the usability of our products and website and the effectiveness of our communications; and (4) otherwise manage and enhance our products and website, and help ensure they are working properly. We may create aggregated, de-identified and/or anonymized data from your Personal Information and other individuals whose Personal Information we collect. We make Personal Information into de-identified and/or anonymized data by removing information that makes the data identifiable to you. We may use this aggregated, de-identified and/or anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Site and promote our business, and to train our artificial intelligence models and for other machine learning purposes; We may also collect transaction-related information (such as preferred means of payment, billing information, billing address, and/or a history of purchases through our Site).
Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without cookies you may not be able to use all of the features of our Site.
You have control regarding our use of Personal Data for direct marketing. In certain markets, you will need to expressly consent before receiving marketing. In all markets, you can choose to not receive marketing communications at any time. If you no longer wish to receive marketing communications from Bluvo, or remain on a mailing list to which you previously subscribed, or receive any other marketing communication, please follow the unsubscribe link in the relevant communications or contact us as specified below.
• With vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
• In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation;
• If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property and safety of us or any third-party;
• In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company;
• With your consent or at your direction; and
• We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.
Artificial intelligence ("AI") technologies, such as those provided by our AI platform providers, OpenAI, Anthropic, Google, and AWS are used to operate the chat and/or user input/prompt features that you can use to communicate with us and/or input your prompts and other data through the Services. WE ADVISE AGAINST SHARING PERSONAL INFORMATION IN CHATBOT INTERACTIONS.
Specific provisions for EU-residents: This Section VI applies to you, if you are from the European Union. Bluvo adopted the following provisions, to comply with the EU 2016/679 Directive General Data Protection Regulation ("GDPR"), pursuant to which Bluvo will be considered as a "Data Controller" with respect to our use of Personal Information of resident of the European Union.
Legal Basis. We base our processing of any personal data as "Data Controllers" based on the following lawful grounds: Bluvo relies, primarily, on your consent to the terms of this Privacy Statement as a legal basis for processing:
A. any Personal Information related to you or communicating any other promotional material
B. may collect and use your Personal Information when it is necessary for one of the legitimate uses set out in Section II above, which we believe are not overridden by your fundamental rights.
C. may process your Personal Information to comply with a legal obligation and to protect our users' vital interests. If, at any time, you wish to exercise your rights in accordance with the provisions provided by law (including as provided under this Section and Section XII of this Privacy Statement) you may send us an email to via admin@bluvo.co and request: to access your Personal Information together with information about how, and on what basis, such information is being processed. Should you desire to receive such information in a different format than the one that was provided to you, you can contact us via admin@bluvo.co and we shall use commercially reasonable efforts to accommodate your request, if applicable; rectify any of the Personal Information being held when such information is inaccurate; to delete or restrict access to your Personal Information in limited circumstances as described under the GDPR. Please note that if we need to delete any Personal Information related to you, as per your request, it can take time until we completely delete residual copies of such data from our servers and backup systems.
D. to withdraw your consent to the processing of your Personal Information. However, please note that exercising this right will not affect the lawfulness of any previous processing activities based on consent that was lawfully obtained before its withdrawal.
E. to obtain and reuse your Personal Information for your own purposes across different services, as part of your right to data portability.
Please note that you have the right to complain to a Data Protection Authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority in the European Economic Area ("EEA"). If you have any concerns with respect to our methods of processing any Personal Information related to you, or if you wish to withdraw your consent, for any reason, kindly let us know by sending an email to admin@bluvo.co. If you reside in a country from the European Economic Area, then, by agreeing to the terms of this Privacy Statement, you agree to Bluvo sharing your Information outside of the European Economic Area. These transfers are subject to special rules under data protection laws. If this happens, we will ensure that the transfer will be compliant with data protection law and all personal data will be secure. Our standard practice is to use 'standard data protection clauses' which have been approved by the European Commission for such transfers. Bluvo shall not charge you for requesting to exercise any of the aforementioned rights.
Please also note that we cannot change, edit or delete information that is stored on a public blockchain.
This Section VII applies to you only if you reside in the State of California, United States. Bluvo adopted the following provisions to comply with the California Consumer Privacy Act ("CCPA") and any terms defined in the CCPA have the same meaning when used in this Section VII.
The following categories reflect the type of personal information which Bluvo has collected within the last twelve (12) months:
A. Identifiers and Personal information as listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), for example, first names, surnames, telephone numbers, address, online Identifier, Internet Protocol address, business or private email addresses, account usernames, as well as Personal Information as such term is defined in this Privacy Statement.
B. Electronic network activity information, including, but not limited to, browsing history and any additional information related to your interaction with our Service.
Bluvo has obtained such information as set forth in this Section VII and Personal Information as provided under Section I above (for the purpose of this Section VII, the "Personal Data").
Bluvo may use the Personal Data it collects or receives for its legitimate interests (as set out in Section II above), which Bluvo believes are not overridden by your fundamental rights. Bluvo may also disclose such Personal Data to third parties for its legitimate purposes as described herein.
In the preceding twelve (12) months, Bluvo has disclosed the following Personal Data for our business purposes:
A. Identifiers (including your name, email address, profession).
B. Personal Data's categories as listed in the California Customer Records statute.
C. Inferences.
In the preceding twelve (12) months, Bluvo has not sold any of your Personal Data.
Your rights as a California Resident. You are entitled to request the following specific rights under the CCPA, solely with respect to Personal Data related to you:
A. Request to know (1) what categories and specific components of Personal Data we collect about you and from which sources; (2) categories of Personal Data that we disclosed for the purpose described in Section II above, and (3) the categories of third parties with whom we have shared any particular category of your Personal Data. If we disclose any of your Personal Data to a third-party, we will provide you, after authenticating your identity, with a list that will identify the specific category of your Personal Data which was disclosed.
B. Request that we delete any Personal Data we collect about you. After authenticating your identity, we will delete (and direct our service providers to delete) any Personal Data related to you from our records, unless an exception applies. Please note that if we need to delete any Personal Data related to you following your request, it can take time until we completely delete residual copies of Personal Data from our servers and backup systems.
C. Instruct us not to sell any Personal Data related to you that was collected by us.
D. You have the right not to be discriminated against by Bluvo, for exercising your rights under the CCPA.
If you have any concerns about how we process Personal Data related to you, or if you wish to withdraw your consent, for any reason, kindly let us know by sending an email to admin@bluvo.co. Please note that exercising this right will not affect the lawfulness of any previous processing activities based on consent that was lawfully obtained before its withdrawal. Also, please note that Bluvo shall not charge you for requesting to exercise any of the rights set forth in this Section VII.
We may transfer your Personal Data to countries outside of your country of residence, including, but not limited to the European Economic Area ("EEA"), as well as the United States, where Bluvo offices and some of its IT systems are located. Personal Data is not processed outside of the countries listed in this Privacy Statement.
Protecting your information is important to us. We maintain administrative, technical and physical safeguards designed to protect against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use of Personal Data.
We strive to only keep your Personal Data only for the period of time needed for legitimate business purposes. In certain circumstances, however, legal or regulatory obligations may require us to retain records for a longer time than we otherwise would.
This Website and the functionalities available are not intended for use by children. For Children. The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any Personal Information about yourself to us. If we learn we have collected Personal Information from a child under 13, we will delete that information as soon as commercially possible. If you believe that a child under 13 may have provided us with their Personal Information, please contact us at admin@bluvo.co.
If you are a parent or guardian and you have reasons to believe that we have collected Personal Information from your underaged child in a manner not permitted by law, please contact us by sending an email to admin@bluvo.co, stating "Minors Content Removal Request" in the subject line, and tell us what information you want us to remove. We will remove any such data to the extent required by applicable law.
If you are a California resident under 18 years old and registered to use the Service, you can ask us to remove any content or information you have posted on the Service. To make such a request, email us to admin@bluvo.co stating "California Under 18 Content Removal Request" in the subject line, and tell us what information you want us to remove. We will make reasonable good faith efforts to remove the post from prospective public view, although we cannot ensure the complete or comprehensive removal of the content and may retain the content as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
If you are resident in countries with applicable data privacy laws you have have the right, subject to certain exceptions, to request a copy of the Personal Data we are processing about you, to require that any incomplete or inaccurate Personal Data is amended, to request that we delete your Personal Data (although we may not be able to delete certain data due to legal or other obligations), to object to the use of your Personal Data or to withdraw consent. You may also have a right to lodge a complaint with the local data protection authority if you believe that we have not complied with the applicable data protection laws. We may update this Privacy Statement from time to time in response to changing legal, technical, or business developments. When we update our Privacy Statement, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Statement changes if and where this is required by applicable data protection laws.
You can see when this Privacy Statement was last updated by checking the last updated date displayed at the top of this Privacy Statement. It is your responsibility to check the last updated date.
Certain third-party services, websites, or applications you use, or navigate to or from our Site or made available by using our Site may have separate user terms and privacy policies that are independent of this Privacy Statement. We are not responsible for the privacy practices of these third-party services or applications. We recommend carefully reviewing the user terms and privacy statement of each third-party service, website, and/or application prior to use.
Our Security Safeguards. We have established commercially reasonable safeguards to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration and destruction, but we cannot guarantee that your information will never be disclosed in a manner inconsistent with this Privacy Statement (e.g., as a result of unauthorized acts by third parties that violate applicable law, or our or our affiliated providers' policies). Please be aware that despite our efforts, no data security measures can guarantee 100% security.
Your Obligations. You may login to your organization portal via third-party credentials. We may use passwords and other technologies to register or authenticate you, and enable you to take advantage of our Site. You must prevent unauthorized access to your organization portal and Personal Information by selecting and protecting your password appropriately, and limiting access to your computer or device and browser by signing off after you have finished accessing your organization portal. We are not responsible for any lost, stolen or compromised passwords, or for any activity on your organization portal via unauthorized password activity.
This Privacy Statement shall be construed in accordance with and governed for all purposes by the substantive laws of the State of Delaware United States, without regard to conflicts of law provisions. You agree that any claim or dispute you may have against us and/or our affiliates, directors, officers, employees, and representatives will be resolved exclusively by the competent courts located in Delaware, United States, and waive any jurisdictional, venue or inconvenient forum objections to such courts.
